Privacy Policy

This Privacy Policy governs the manner in which Oliver Street Dermatology Management, LLC on behalf of its self and its practice entities d/b/a U. S. Dermatology Partners (“US Dermatology” or “we”) collects, uses, maintains and discloses information collected from users (“User” or “you”) of the DermSkinCare.com website (“Site”).

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, type of device, IP address, time zone, technical information about your device, such as the operating system and the Internet service providers you are using, the cookies that are installed on your device, and other similar information. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. Device Information is not considered personally identifiably unless it is combined with contact information, account information, or other information that is unique to you. We only combine automatically collected data with identification data if it is necessary to do so to complete a task you have asked us to perform (for example, to troubleshoot a problem you are having with the Site) or if we tell you (for example, if you fill out a form the tells you it will be matched with automatically collected data).

We Collect Device Information Using the Following Technologies:

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. Our Site uses “cookies” to enhance User experience. Cookies help identify your computer and may allow some tracking of information. For example, cookies can remember you between visits. You can set your web browser to refuse cookies, or to alert you when cookies are being sent. However, if you refuse cookies, some parts of the Site may not function properly. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally, we collect personally identifiable information that you provide to use when you register for the Site, fill out a form, search for goods and services you wish to obtain or otherwise engage in other activities, services, features or resources that we make available on the Site that request your information. For example, we may collect your email in order to subscribe you to updates, newsletters or promotional notices.

When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number). We refer to this information as “Order Information”. All credit and debit card data is provided directly to our PCI-compliant third- party payment processor. We do not directly access, handle, or store identifiable data contained on your credit or debit card aside from the last four digits of your payment card to facilitate future orders and/or generate reports. We may keep a record of your purchases.

You may also register for an account the Site. To do so, we collect certain information from you, including your name, email and other personal information that you provide us to register for an account. We refer to this information as “Account Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information, Order Information, and Account Information.

How Do We Use Your Personal Information?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).

Additionally, we Use Order Information to:

Communicate with you
Screen our orders for potential risk or fraud
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We use Account Information to manage your user account, provide order history, and to allow you to more easily reorder products and maintain a list of favorite products. You may be required to provide certain Account Information to access certain areas of the Site. For example, some areas of the Site may require use of a username and password. • You are responsible for maintaining the confidentiality of your account username and password and for restricting access to your account username and password. You agree to accept responsibility for all activities that occur under your account or password. You agree to provide only current, complete, accurate and truthful contact information.

Additionally, we may use Personal Information to:

Improve customer service. Information you provide helps us respond to your customer service requests and support needs more efficiently.
To improve user experience. We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site
To improve our Site. We may use feedback you provide to improve our Site and the offering of products and services.
To run a promotion, contest, survey or other Site feature. To send Users information they agreed to receive about topics we think will be of interest to them.
To send periodic emails. We may use the email address to respond to User inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. We may also use email to notify Users of important information, such as if there is ever a breach of security. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.
For the purposes specified at the time of collection. There may be other purposes that are specified when the information is collected.
As otherwise required or permitted by law. There may be times when the law permits or requires Us to use information for other purposes.

Sharing Your Personal Information

We do not sell, trade, or rent your Personal Information to others.

We share your Personal Information with third parties to help us use your Personal Information, as described above. We may share information about visitors to the Site:

With our business partners, trusted affiliates and advertisers to help provide services that are described above;
With third party service providers that help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys, if you have agreed to receive them;
With companies that provide services to us, such as website hosting services or credit card processing services;
With companies that are disclosed to you at the time you provide the Personal Information.

When we share certain Personal Information for our business purposes, we, where required by law, enter into an agreement that sets forth the purpose of the sharing of such Personal Information and that the recipient must keep that Personal Information confidential and not use it for purposes other than performance of the contract.

We also use Google Analytics, which uses cookies to analyze website traffic, to help us understand how our customers use the Site. For instance, Google Analytics tells us how many people have visited our website, what pages they visit, and how long they visit each page. We typically do not connect this analytical information with identifiable information like name or phone number, although the analytics may associate information with a geographic location, device identifier, or IP address. Users agree that their anonymized information may be used by Us to perform services or run Our business. We will not re- identify anonymized data.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a court order, subpoena, search warrant or other lawful request for information we receive, to prevent or investigate a crime or fraud or to otherwise protect our rights. We reserve the right to report to appropriate law enforcement or government agencies activities that we, in good faith, believe to be harmful or unlawful, with or without providing notice to you.

Behavioral Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

Do Not Track

Many internet browsers have "Do Not Track" features which, when turned on, send a signal (the "DNT signal") to the websites a user visits that indicates the use does not want to be tracked. Because there is not yet a common understanding of how to interpret DNT signals, and there is no common definition of "tracking", we do not currently respond to DNT signals on the Site.

Your Rights

You have the right to request a copy of the Personal Information we hold about you and to ask that your Personal Information be corrected, updated, or deleted. You have the right to request information regarding the categories of information that have been collected about you, the purpose for collecting or selling that information, the categories of third parties with whom the information has been shared; and the specific data that has been collected. If you would like to exercise this right, please contact us through the contact information below. We will confirm receipt of your request and ask you to confirm your identity in order to fulfill these requests. If we are able to collect and provide the information, we will do so. In some cases, we may not be able to collect and provide the information, because of the way the data is used and stored. We may not be able to correct that information if, for example, we did not save the information in question or because we do not yet have a process to update the information. For Users who have registered for an account with the site, you may log into the Site to review and update your Account Information.

Additionally, We note that we are processing your information to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.

You understand and agree that a request for us to delete or no longer process your data means that you can no longer use the Site, as it is necessary for us to process your data to provide the services.

We will not discriminate against you if you exercise any of your rights.

Data Protection

We use reasonable data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your Personal Information, username, password, transaction information and other data stored on our Site. However, it is impossible to guarantee security of any website, or of data transmitted over the Internet. While we seek to protect information, we cannot guarantee the security of any Personal Information you provide through the Site. While we have implemented security measures, you transmit data, including Personal Information, to us at your own risk.

Data Retention

We retain Personally Information only as long as it is needed for permissible business purposes, as required by law, and in accordance with record retention policies. Upon expiration of the retention period, Personal Information is disposed of in a secure manner. While you may request deletion of Personal Information, it can only be deleted in accordance with our data retention policies and as permitted by law. Further, some Personal Information may remain in databases, access logs, backup media, and other records. We cannot update or remove information from records of third parties.

California Consumer Privacy Act (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) gives you certain rights regarding your personal information. Your CCPA rights include:

Access: You may ask us to disclose the Personal Information that we have collected about you and how it is used and shared.
Deletion: You may ask us to delete Personal Information that we have collected about you.
Opt-out: You can opt out of “sales” of Personal Information about you. Please note that we do not sell personal information for monetary consideration. However, we may share certain personal information with third parties under circumstances which might be deemed a “sale” under the CCPA.

Third Party Websites

You also may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. When you click on a link to a third-party site, you leave our Site and this Privacy Policy no longer applies. We do not endorse the products or services of any other companies that may have links on our Site, do not control the content or links that appear on such sites and are not responsible for the practices employed by websites linked to or from our Site. In addition, these sites and services may have their own privacy policies and customer service policies, and the content of the third party website may change. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website’s own terms and policies. We encourage you to read the terms and policies of any third party site or service you navigate to.

Protecting Children's Privacy

The Site is intended to be used by individuals over the age of 18, and use by anyone under 13 years of age is prohibited. We do not knowingly collect Personal Information from children under 13 years of age. If we become aware that we have collected Personal Information from a child under 13 years of age, we will promptly remove such information. If you believe we have collected information from your child, please notify us through the contact information below.

Changes

We may update this privacy policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. We have the discretion to update this privacy policy at any time. When we do, we will revise the "updated" date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we collect and use your Personal Information. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Access from Outside the United States; Acceptance of Policy

We only intend to offer access to goods and services within the United States, and the Site is only intended to be used by Users in the United States. If you are visiting the Site from outside the United States of America, your information will be transferred to, stored, and processed in the United States. The privacy laws of the United States may not be as protective as those in your jurisdiction. By visiting the Site, you consent to the transfer of your information to the United States and the use and disclosure of your information as described in this Privacy Policy.

We collect and use information as reasonably necessary to fulfill requests by Users, to operate our business, and to comply with law. By using this Site, you signify your acceptance of this policy.
